We may update this Agreement by posting a revised version on our website. By continuing to use our Services, you accept any revised Agreement.
Service License: Subject to the terms hereof, we grant you access to our Services. This includes the right to:
- Upload and store surgical data
- Review and download your data and different reports
- Review and download certain types of pooled registry data
Validation: To set up an account you must confirm that you are a qualified and authorised healthcare professional practicing lens replacement surgery. You must on demand supply evidence to confirm you are a qualified and licenced practitioner in lens replacement surgery, failure to do so will result in immediate account suspension.
You will be required to provide all requested information during registration including an email address. You consent to receive notices from CLEARlog at this email address.
Secondary User Access: Your plan will allow you to grant secondary users access to your account and to review and edit certain elements of your surgical records. Both you and each team member are deemed a party to this Agreement. You are responsible for the actions of your team members and must monitor their access and usage.
Account Security: You are responsible for all activity that occurs under your account, including unauthorized activity. You must safeguard the confidentiality of your account credentials. If you are using a computer that others have access to, you must log out of your account after each session. If you become aware of unauthorized access to your account, you must change your password and notify us immediately.
Fees: You must pay all fees (plus any taxes) during your subscription period and any renewal periods. Our fees may include a fixed monthly or annual fee.
Free Trials and Discounts: We may offer free trial or discounted subscriptions. When a free trial period ends, your paid subscription begins (unless you have cancelled) and you must pay the full monthly or annual fee. If we provide a discount for the first subscription period, you must pay the discounted fee; in any renewal, you must pay the full fee.
Refund Policy: Subject to the terms hereof, subscribers may cancel and receive a full refund of their initial purchase with thirty (30) days after purchasing an annual plan and five (5) days after purchasing a monthly plan. Our refund policy does not apply to:
Automatic Renewal: To the extent permitted by applicable law, subscriptions automatically renew at the end of each subscription period unless cancelled beforehand. Monthly plans renew for periods of 1 calendar month. Annual plans renew for 1 year periods. You must pay the annual or monthly fee (plus any taxes) when each renewal period starts.
Lapse Policy: When a subscription ends, the account will be suspended and no further access will be possible, all stored data will be retained for 6 months and accessible if subscription is reinstated or provided as a CSV file once during that period on request.
Acceptable Use Policy
No sensitive data should be entered into the system and no patient identifiable information should be recorded.
All information entered should be accurate. CLEARlog reserves the right to suspend or cancel accounts if evidence of deliberate or negligent input of incorrect data.
Authorisations Granted by You
You agree that data you enter may be pooled with other data and shared with other users and our sponsors provided minimum quantities have been achieved to ensure no individual data elements could be attributed to a specific user.
Limitation of Liability
To the extent permitted by applicable law CLEARlog shall not be liable for any indirect, incidental, special, consequential, or exemplary damages, including damages for loss of business, profits, goodwill, data, or other intangible losses.
This Agreement will be governed by the laws of England and Wales.
CLEARlog will not be liable for any delay or failure caused by a force majeure event.
